ACTICLEAR CUSTOMER CARE

Terms of Service

Terms for using the ActiClear online store.

Last updated: 2026-09-29

Overview

Welcome to ActiClear. ActiClear is operated by CARBON HUB COMMERCE CO., LIMITED. In these Terms, “ActiClear,” “we,” “us” and “our” refer to that company. We operate this online store and website, including its information, content, features, tools, products and services (the “Services”). Our store is powered by Shopify.

These Terms of Service (“Terms”), together with the policies they reference, describe your rights and responsibilities when using the Services. Please read them carefully, including the sections on warranties and liability. By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use the Services. Our Privacy Policy explains how personal information is handled.

SECTION 1 - Access and account

You must be at least the age of majority where you live to place an order or create an account. If you allow a minor dependent to use the Services on a device you own or manage, you are responsible for supervising that use.

You may need to provide information such as your email address, billing details, payment details and shipping address. You agree to provide information that is accurate, current and complete, and that you have the right to provide.

If you have an account, keep your sign-in details secure and contact us if you suspect unauthorized use. You are responsible for activity you authorize through your account. You may not sell, transfer, assign or license your account to another person.

SECTION 2 - Our products

We aim to describe and show our products accurately. Colors and appearance on your screen may vary with your device and display settings. These differences do not limit any express product commitments, our Returns & Refunds policy, or your rights under applicable law.

We may update product descriptions, discontinue products or limit quantities by customer or destination. Availability may change. Updates do not remove obligations we already owe for an accepted order. Please follow the product label and the instructions provided for the product.

SECTION 3 - Orders

Placing an order is an offer to purchase. We may accept or decline an order, including because of availability, payment problems, suspected fraud, an error or a purchase restriction. An order is accepted when we confirm acceptance after receiving and processing payment. Please review your details before submitting your order.

If you want to change or cancel an order, contact us as soon as possible. We will check whether this is still possible; fulfillment may already have started. See our Shipping & Delivery policy for details.

If we decline, change or cancel an order, we will notify you using the contact details you provided. If we decline or cancel all or part of an order after charging you, we will refund the amount charged for the declined or canceled part to your original payment method.

Returns, refunds, exchanges and replacements are handled under our Returns & Refunds policy, without limiting your statutory rights. Purchases are for personal or household use, not for commercial resale or export.

SECTION 4 - Prices and billing

Prices, discounts and promotions may change. The price for your order is the price shown when you place it, subject to the error-correction process in Section 12. Applicable taxes and shipping charges are shown at checkout before payment unless expressly included in the displayed price.

Prices may differ from those offered by other retailers or sales channels. A promotion may have separate terms; those terms govern that promotion if they conflict with these Terms.

Provide accurate, current and complete purchase, payment and account information, and update it as needed so we can complete transactions and contact you. You must be authorized to use the payment method you provide and agree to pay the prices and applicable charges shown for your order.

SECTION 5 - Shipping and delivery

Our Shipping & Delivery policy explains where we ship, shipping charges, estimated delivery times and tracking. Delivery times are estimates and may be affected by carrier delays, weather or other events outside our control.

For a delayed, missing or damaged delivery, contact us with your order number and a brief description. We will help investigate and handle the issue under our Shipping & Delivery and Returns & Refunds policies. Keep a damaged item and its packaging, and wait for our instructions before returning a damaged or leaking product.

The Returns & Refunds policy explains the applicable request periods, return instructions, responsibility for shipping costs and refund process. Nothing in this section limits the commitments in those policies or your rights under applicable law.

SECTION 6 - Intellectual property

The Services and their content, including text, images, graphics, logos, video, audio, design and arrangement, are owned by ActiClear or the relevant rights holders and are protected by intellectual property laws. Rights in content submitted by customers remain subject to Section 11.

You may use the Services for personal, non-commercial purposes. Normal browsing, temporary browser copies and keeping your own order records are permitted. Unless permitted by law or authorized in writing, you may not reproduce, distribute, modify, sell, publish or commercially exploit our content. No other license to our intellectual property is granted by these Terms.

ActiClear names and logos may not be used without our prior written permission. Shopify trademarks belong to Shopify. Other trademarks belong to their respective owners.

SECTION 7 - Optional tools

We may make third-party tools available through the Services. Their availability does not mean that we control or endorse them. Review the provider’s terms before using a tool and decide whether it is suitable for you.

To the extent permitted by law, optional third-party tools are provided “as is” and “as available,” without additional warranties from us. The safeguards and limits in Sections 15 and 16 apply, including protection of our express commitments and rights that cannot legally be excluded. New features we make available through the Services are also subject to these Terms and any additional terms provided for them.

SECTION 8 - Third-party links

The Services may link to third-party websites, content or services. We do not control their content or independently verify every statement they make. A link does not by itself mean that we endorse the third party.

Before using a third-party website or buying from it, review its terms and privacy practices. Questions about its products or services should be directed to that provider. Any exclusion of our responsibility for third-party services is subject to Sections 15 and 16 and applicable law.

SECTION 9 - Relationship with Shopify

Shopify provides the platform that enables us to operate this store. Purchases from this store are transactions with CARBON HUB COMMERCE CO., LIMITED, trading as ActiClear. Shopify is not the seller of our products and does not assume our order, delivery or after-sales obligations.

To the extent permitted by law, Shopify and its affiliates are not responsible for claims arising from our sale of products to you. This does not exclude any responsibility that cannot legally be excluded or limit your rights under applicable law.

SECTION 10 - Privacy policy

Our Privacy Policy explains how we collect, use and share personal information when you use the Services, including information used for orders and customer support, and the choices and rights available to you.

Shopify also processes personal information to provide the platform and related services. See Shopify’s Privacy Policy. Information may be processed by Shopify and other service providers in countries other than where you live, as explained in our Privacy Policy.

SECTION 11 - Customer messages, product suggestions and reviews

Ordinary order questions, customer-service messages and their attachments are not covered by the product-suggestion permission below. We handle those materials for customer support and as described in our Privacy Policy. This section does not change the customer-service response commitment on our Contact page.

If you voluntarily submit a non-confidential product idea or suggestion, you permit us to use it to evaluate, improve and develop products and the Services. Unless we agree otherwise in writing, we do not promise to review or adopt every suggestion, keep it confidential or pay compensation. Please do not submit trade secrets, confidential information or third-party proprietary materials.

If you submit a review or other content for public display on our store, you permit us to display it and reproduce it as needed to operate that review or content feature, together with the public display name you choose. You keep ownership of your content. This section does not grant permission to use private customer-service correspondence, your name or your photo in marketing; permission for those uses must be obtained separately.

Submit only content you own or have permission to share. It must be accurate about your experience, must not impersonate someone else, and must not infringe intellectual property, privacy or other rights, contain unlawful threats, or include malicious code. Disclose any compensation or incentive connected with a review. We may remove content that breaches these requirements. A negative opinion alone does not violate these requirements.

SECTION 12 - Errors, inaccuracies and omissions

Occasionally, product descriptions, prices, promotions, shipping charges, delivery estimates or availability information may contain an error or omission. We may correct the information and, where necessary and permitted by law, change or cancel an affected order, including after it has been submitted.

If a correction affects your order, we will notify you. Declined or canceled amounts already charged will be refunded to the original payment method as described in Section 3. This section does not remove our obligations under applicable law or our published customer policies.

SECTION 13 - Lawful use and protection against abuse

You may browse, shop and use the Services lawfully, including with accessibility tools and tools we authorize. These Terms do not prohibit ordinary browsing. You must not use the Services to commit fraud, impersonate others, infringe rights, threaten or harass people, send spam or distribute malicious code.

You must not obtain another person’s personal information without authorization, access an account or data you are not entitled to access, bypass security or access restrictions, disrupt the Services, or extract content or data in bulk without authorization. These rules apply whether you act manually or use software, automated tools or an agent acting on your behalf.

We may apply access limits or suspend access to address misuse or security risks, subject to applicable law and Section 14. Permission to use a tool does not authorize access beyond the scope granted or override technical access controls.

SECTION 14 - Termination

We may suspend or terminate your access to all or part of the Services if you breach these Terms, misuse the Services or create a security or legal risk. We may also stop providing a Service. We will provide notice where required by law. You remain responsible for valid amounts owed before termination.

Termination does not remove our obligations for amounts already paid, applicable refunds or after-sales support, or rights that cannot be excluded by law. Provisions that by their nature need to continue will survive, including intellectual property, permitted uses of submitted content, privacy, liability, indemnification, dispute remedies and amounts lawfully due.

SECTION 15 - Disclaimer of warranties

General information on the Services does not replace the label or instructions supplied with a product. We take reasonable care with our content but do not promise that the website will always be uninterrupted, timely, secure or error-free.

To the extent permitted by applicable law, and except for our express product and service commitments, the Services and products are provided “as is” and “as available,” without additional express or implied warranties, including implied warranties of merchantability, fitness for a particular purpose, title or non-infringement.

Nothing in these Terms excludes or reduces the refunds, delivery assistance or after-sales commitments we make in our customer policies. Nothing excludes any warranty, consumer right or liability that applicable law does not allow us to exclude or limit. Where a disclaimer is not permitted, it does not apply to you.

SECTION 16 - Limitation of liability

To the extent permitted by applicable law, ActiClear and its affiliates, directors, officers, employees, agents, contractors and service providers will not be liable for indirect, incidental, special, punitive or consequential losses arising from use of the Services, such as lost profits, revenue, savings or data, whether the claim is based on contract, negligence or another legal basis.

This limitation does not cancel or reduce our express product commitments, order refunds, delivery assistance or after-sales obligations under our customer policies. It does not exclude or limit liability, remedies or consumer rights that cannot be excluded or limited by law. If the law where you are entitled to protection does not allow a stated limitation, that limitation does not apply to you.

SECTION 17 - Indemnification for third-party claims

To the extent permitted by law, you agree to compensate ActiClear and its affiliates, officers, directors, employees and service providers for losses, liabilities and reasonable legal costs arising from a third-party claim, but only to the extent caused by your breach of these Terms, violation of law or infringement of that third party’s rights. Merely browsing or making an ordinary lawful purchase does not create an obligation to indemnify us.

We will notify you of a claim for which we seek indemnification and allow you a reasonable opportunity to participate in its defense. We may coordinate the defense with reasonable cooperation from you. We will not agree to a settlement that requires an admission, payment or other obligation from you without your consent. This section does not require you to compensate anyone for losses caused by that person’s own unlawful conduct or breach of these Terms, or limit your non-excludable rights.

SECTION 18 - Severability

If a provision of these Terms is found unlawful, void or unenforceable, it will apply only to the extent lawfully enforceable, and any unenforceable part will be treated as removed. The remaining provisions will continue to apply to the extent permitted by law.

SECTION 19 - Waiver and entire agreement

A failure or delay by either party to enforce a right under these Terms does not by itself waive that right.

These Terms, the policies they reference and any applicable order or promotion terms form the agreement for your use of the Services and the relevant purchase. They replace earlier terms on the same subject, except for rights and obligations already accrued and any separate written agreement that expressly applies. Nothing in this section overrides rights or obligations imposed by applicable law.

SECTION 20 - Assignment

You may not transfer your account or your rights and obligations under these Terms without our prior written consent, except where applicable law permits otherwise. We may transfer our rights and obligations in connection with a business transfer or reorganization, subject to applicable law. Such a transfer does not reduce the consumer protections or customer-policy commitments that apply to your purchase. We will notify you where required by law.

SECTION 21 - Applicable law, consumer rights and dispute remedies

Applicable law determines how these Terms and a dispute are interpreted and resolved. Nothing in these Terms deprives you of mandatory consumer protections or remedies that apply to your purchase or use of the Services.

If you have a concern, you may contact us so we can try to resolve it. Doing so does not prevent you from seeking any remedy available under applicable law, contacting a competent consumer authority or bringing a claim before a court that has jurisdiction under applicable law. These Terms do not require arbitration or waive your right to bring or participate in a class action where that right is available under applicable law.

SECTION 22 - Headings

Headings help you navigate these Terms and do not change the meaning of the provisions.

SECTION 23 - Changes to these Terms

We may update these Terms by posting a revised version on this page. We will identify the revision date and provide notice of material changes as required by applicable law. Any notice will state when the changes take effect.

Please review the Terms when you use the Services. Continued use after changes take effect constitutes acceptance to the extent permitted by law. Changes do not retrospectively remove rights or obligations relating to orders already accepted.
