1. About this policy
ActiClear is operated by CARBON HUB COMMERCE CO., LIMITED ("ActiClear," "we," "us" or "our"). This Privacy Policy explains how personal information is collected, used and disclosed when you visit our website, shop with us, use our related features and services, or contact us (together, the "Services"). Our store is powered by Shopify.
This policy covers our handling of personal information in connection with the Services. Shopify and other providers may also process information under their own privacy notices, as explained below. If this policy conflicts with our Terms of Service about the collection, use or disclosure of personal information, this policy controls on those matters. Reading this policy or browsing the Services does not replace consent where consent is required by law.
2. Personal information we collect or process
Personal information means information that identifies, relates to, or can reasonably be linked to you or another person. It does not include information that has been anonymized or de-identified so that it cannot reasonably be linked to a person. The information involved depends on how you use the Services, the features you choose and applicable law.
The table connects the main information categories with their uses and the types of providers involved. Recipients vary by transaction or feature. Listing a provider does not mean it receives every item in a category. More detail about sources, purposes and disclosures follows.
| Information | Main uses | Recipients |
|---|---|---|
| Contact details | Order contact, delivery and support | Shopify; support, fulfillment and delivery providers |
| Orders and shopping activity | Purchases, fulfillment, returns and store improvements | Shopify; fulfillment, payment and analytics providers |
| Payment and billing details | Payments, refunds and fraud checks | Shopify; payment and fraud-prevention providers |
| Account and preferences | Account access and selected settings | Shopify; account and technical service providers |
| Messages and attachments | Customer support and issue resolution | Shopify; support and relevant service providers |
| Device and website activity | Store operation, security, analytics and, where used, advertising | Shopify; technical, analytics and, where used, advertising providers |
- Contact details: your name, email address, phone number, billing address and shipping address.
- Orders and shopping activity: products you view or add to your cart, purchases and order history, and information about returns, exchanges, cancellations and delivery.
- Payment and billing details: the payment method, billing information, transaction amount, payment status, confirmation and refund information. Depending on your chosen payment method, Shopify or the relevant payment provider also processes card or financial-account details needed to complete the transaction. The details available to each party depend on the payment service and transaction; this category does not mean every party receives the same information.
- Account information: if you use an account feature, account identifiers, sign-in or authentication information relevant to that feature, and your preferences and settings. Authentication information is handled through the account service you use.
- Communications: what you send us in questions, support requests, feedback and attachments, such as order details or photos relevant to an issue. If you choose to submit a public review through an available feature, it may also include the display name and content you select.
- Device and usage information: your IP address, browser and device details, network information, cookies or similar identifiers, pages and products visited, and how and when you interact with the Services.
- Inferences: preferences or interests inferred from shopping or browsing information, where used to personalize or improve the Services or for the marketing purposes described in this policy.
Please provide information relevant to your request. Do not send payment-card details, account passwords or other unnecessary sensitive information in ordinary support messages.
3. Where information comes from
- Directly from you: when you place an order, enter contact details, use an account, select preferences or communicate with us.
- Automatically through the Services: when your browser or device connects to the store, including through cookies and similar technologies.
- From service providers: including Shopify and providers involved in payment processing, fulfillment, delivery, support, security or analytics, as they provide the relevant service.
- From partners or other third parties: where you direct a service to share information with us, or where a partner supplies information in connection with an interaction or service described in this policy and permitted by law.
Information from these sources may be combined where relevant to the purposes described here, such as connecting a delivery update or support request with your order.
4. How we use personal information
- Provide the store and complete transactions. We use information to process payments, fulfill and deliver orders, send order updates, handle returns, exchanges, cancellations and refunds, and maintain the records needed for these activities.
- Support the features you use. Where you use account, preference, review or personalization features, we use the relevant information to operate them, remember selections and make the shopping experience useful to you.
- Respond and improve. We use inquiries, order history and relevant attachments to answer questions, investigate product or delivery issues and provide customer support. Usage and feedback information may help us understand and improve products and the Services.
- Marketing and advertising. Where we carry out these activities, we may use contact details, shopping activity, device information or inferred interests to send promotional emails, understand campaign performance or display relevant advertising on our store or other services. These uses are subject to applicable consent requirements and your privacy choices. They may involve advertising based on activity across different merchants and websites.
- Security and fraud prevention. We use relevant account, transaction, device and usage information to authenticate access, investigate suspicious transactions or misuse, protect customers and the Services, and detect or address fraud, unlawful activity and security threats.
- Legal and business obligations. We use information to maintain required records, comply with law and valid legal requests, establish or defend legal claims, resolve disputes and investigate or enforce our terms and policies.
Ordinary order questions, support emails and their attachments are handled under this policy. Sending them does not turn them into public reviews or grant the product-suggestion license in our Terms of Service on feedback. That section addresses voluntarily submitted, non-confidential product suggestions; any personal information in a suggestion remains subject to this policy.
5. Who receives personal information
We disclose information as relevant to the following purposes and subject to applicable law:
- Shopify and service providers. Providers help operate the store and provide hosting, technical support, payment processing, fraud prevention, analytics, customer support, data storage, fulfillment and delivery. They receive information relevant to the service they perform.
- Amazon Multi-Channel Fulfillment (MCF) and carriers. We use Amazon MCF for order fulfillment. We provide the recipient and order information needed for fulfillment and delivery, such as delivery details and the items to be shipped. Carriers and other fulfillment providers receive the information needed for their part of that process. This fulfillment disclosure is distinct from advertising-data sharing and does not mean that full payment-card information is supplied for shipment.
- Marketing and advertising partners. Where their services are used, these partners may receive contact, device or shopping information relevant to promotions, measurement or advertising. Some process information under their own privacy notices. Certain uses may be considered a "sale," "sharing" or "targeted advertising" under applicable privacy law. Use Privacy Choices for the relevant opt-out options.
- At your request or with your permission. For example, when you direct us to share information with a service you choose or choose to make review content public.
- Affiliates and business transactions. Information may be disclosed to an affiliated entity where relevant to the purposes in this policy, or to parties involved in a proposed or completed merger, acquisition, reorganization, sale of assets or bankruptcy, subject to applicable safeguards and law.
- Legal and protective purposes. We may disclose information to authorities, advisers or other parties when required by law or valid legal process, to address fraud or security threats, to enforce applicable terms, or to protect our rights or the rights and safety of others.
6. Our relationship with Shopify
Shopify hosts our store and processes information about your visits, purchases and other use of the Services to provide and improve its services. Information submitted to the store is shared with Shopify and relevant providers, which may process it outside your country.
Where Shopify enhanced features, including those supported by Shopify Network Intelligence, are used, Shopify may combine information about your interactions with our store, other merchants and Shopify to provide those features. These uses can include personalization, improving services, protecting businesses and customers, and advertising based on activity across merchants. Applicable consent and opt-out choices govern these uses.
For processing in which Shopify determines how your information is used for its own services, Shopify is responsible for that processing and for responding to the corresponding privacy requests. Read the Shopify Consumer Privacy Policy for details. Depending on where you live, the Shopify Privacy Portal provides choices and requests, including those concerning enhanced services. You can contact us about our handling of your information using the details below.
7. Cookies, advertising and communication choices
Cookies and similar technologies support functions such as the shopping cart, preferences, security and understanding store use. Where analytics, personalization or advertising tools are used, these technologies may also support those purposes, subject to applicable consent requirements. You can use the cookie controls presented on the Services, where available, and your browser settings. Blocking some cookies may affect store functions.
- Sale, sharing and targeted advertising: visit Privacy Choices to use the available opt-out controls. These choices concern data use for advertising; they are separate from unsubscribing from promotional emails.
- Global Privacy Control (GPC): where applicable law requires, we treat a recognized GPC opt-out preference signal as a request to opt out of sale, sharing or targeted advertising for the browser and device sending it. If we can associate that device with a Shopify account, we apply the request to that account as well. You may need to set your preference on other browsers or devices. Learn about the signal at Global Privacy Control. Other browser "Do Not Track" signals are not recognized as these opt-out requests.
- Promotional emails: if you receive marketing emails from us, you can unsubscribe using the link in the email. We may still send messages needed for your orders, account or customer support.
For questions about these choices or difficulty using a control, contact info@acticlear.co. Our contact channel supplements the available privacy controls.
8. Your rights and how to make a request
Depending on where you live and the law that applies to our processing, you may have some or all of the following rights. They may have conditions or exceptions.
- Access and know: request access to your personal information and information about its collection, use, sources and recipients.
- Delete: request deletion of personal information we hold, subject to lawful retention requirements or other exceptions.
- Correct: request correction of inaccurate personal information.
- Portability: request a copy of your information in a portable format and, in certain circumstances, transfer to another party.
- Opt out: opt out of sale, sharing or processing for targeted advertising, as those terms are defined by applicable law, using the choices above.
- Other applicable rights: object to or request restriction of certain processing, withdraw consent where processing relies on consent, limit certain uses of sensitive personal information, or exercise rights concerning qualifying automated decisions. Withdrawing consent does not affect processing lawfully carried out before withdrawal.
Use the relevant control on the Services, email info@acticlear.co, or write to the address below. Tell us the right you wish to exercise and enough information to identify the relevant records. You do not need to create an account just to submit a request.
For requests such as access, correction or deletion, we may need to verify your identity as permitted or required by law. We request information appropriate to the request. We do not require identity verification for an opt-out request where the law prohibits it, although information may be needed to identify the data to which it applies. An authorized agent may submit a request where permitted by law; we may ask for proof of authorization and, where permitted, confirmation from you.
We will respond within the period required by applicable law and explain a refusal or extension where required. We will not discriminate against you for exercising a privacy right. Requests about Shopify's own processing can also be made through the Shopify Privacy Portal.
9. Third-party websites and public content
Links on the Services may take you to websites or platforms operated by others. Their privacy and security practices are governed by their own notices and terms. We do not control those sites, and a link does not by itself endorse their content or practices.
Information you choose to post publicly, such as a public review or social-media comment, may be seen, copied or used by others. Consider what you include before posting. Private customer-support correspondence is addressed in Section 4.
10. Children's information
The Services are intended for adults and are not directed to children. We do not seek personal information from children under the age of majority where they live. If you are a parent or guardian and believe your child has provided information to us, contact us so that we can review it and take appropriate action, including deletion where required.
Personal information of individuals under 16 is subject to additional safeguards where applicable, including any required authorization before information may be "sold" or "shared" as defined by law. We do not authorize such uses in violation of those requirements.
11. Security and retention
No system or method of transmission can guarantee complete security. Information sent over the internet may be exposed to risks in transit. Please use appropriate secure channels for sensitive information and protect any sign-in credentials you use for the Services.
We retain personal information for as long as needed for the purposes described in this policy, taking account of the information involved and applicable requirements. Relevant factors include completing orders and after-sales support, maintaining accounts you use, keeping tax and transaction records, handling disputes or legal claims, preventing fraud and meeting legal obligations. These needs can result in different retention periods for different records. A deletion request may therefore be subject to lawful retention exceptions.
12. International transfers
Our operator's contact address is in Hong Kong, and we use Shopify and other providers to serve our customers. Your information may be transferred, stored or processed outside the country where you live, including in countries where we or our providers operate. Privacy laws in those countries may differ from those in your country.
Where a transfer from the European Economic Area or the United Kingdom is subject to legal transfer restrictions, we rely on a recognized mechanism, such as an adequacy decision or applicable standard contractual clauses and UK equivalents, together with any additional safeguards required by law. You can contact us for information about safeguards relevant to your information. This disclosure does not limit rights that apply to you because of where you live.
13. Complaints and appeals
If you have concerns about our handling of personal information or a response to your request, contact info@acticlear.co. Where applicable law gives you a right to appeal a decision on your request, you can use that address and explain that you are requesting an appeal. Depending on where you live, you may also complain to the relevant privacy regulator or data protection authority. Contacting us does not prevent you from using those rights.
14. Changes to this policy
We may revise this policy to reflect changes in our practices, the Services or legal requirements. When an updated policy is published, we will post it on this website, identify the applicable update date and provide any additional notice required by law.
